CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS


GENERAL:

If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188) and other laws in force regarding the sale and delivery of the product they have purchased.

Shipping costs, which are product delivery expenses, will be paid by the buyers.

Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

The purchased product must be delivered complete, in accordance with the characteristics specified in the order, and with documents such as warranty certificate and user manual, if any.

In the event that it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days of learning of this situation. The total amount must also be refunded to the Buyer within 14 days.


IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

If the Buyer does not pay for the purchased product or cancels it in bank records, the Seller's obligation to deliver the product ends.


PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

After the product is delivered, if it is determined that the credit card with which the buyer made the payment was used unlawfully by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days with the transportation cost belonging to the SELLER.


IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

If force majeure circumstances that the Seller cannot foresee occur and the product cannot be delivered on time, the situation will be notified to the Buyer. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if payment was made in cash, this fee will be paid to them in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels, the product price will be refunded to the bank within 14 days from this cancellation, but it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.


BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

The Buyer will inspect the goods/service subject to the contract before receiving delivery; will not receive damaged and defective goods/services such as dented, broken, torn packaging, etc. from the cargo company. The received goods/service will be deemed to be undamaged and sound. The BUYER must carefully protect the goods/service after delivery. If the right of withdrawal is to be used, the goods/service should not be used. The Invoice must also be returned with the product.


RIGHT OF WITHDRAWAL:

The BUYER may exercise the right to withdraw from the contract by rejecting the goods within 14 (fourteen) days from the date of delivery of the purchased product to him/her or to the person/organization at the address he/she indicated, without undertaking any legal and criminal responsibility and without showing any reason, provided that he/she notifies the SELLER through the contact information below.

WITHDRAWAL PERIOD:

If the Buyer purchased a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be used in service contracts where the performance of the service has been started with the consumer's consent before the right of withdrawal period expires.

The costs arising from the use of the right of withdrawal belong to the SELLER.

To exercise the right of withdrawal, written notification must be made to the SELLER by registered mail with return receipt, fax or e-mail within 14 (fourteen) days, and the product must not have been used within the framework of the provisions of "Products for Which the Right of Withdrawal Cannot Be Used" organized in this contract.


EXERCISE OF THE RIGHT OF WITHDRAWAL: 

The invoice of the product delivered to the 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution when returning. Order returns whose invoices are issued in the name of corporations will not be completed if a RETURN INVOICE is not issued.)

Return form, The products to be returned must be delivered complete and undamaged with their box, packaging, and standard accessories, if any.


RETURN CONDITIONS:

The SELLER is obliged to return the total amount and the documents that put the BUYER under debt to the BUYER within a maximum period of 10 days from the receipt of the withdrawal notification and to receive the goods back within a period of 20 days.

If there is a decrease in the value of the goods due to a reason arising from the BUYER's fault or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages in proportion to the fault. However, the BUYER is not responsible for changes and deteriorations that occur due to the proper use of the goods or product within the right of withdrawal period. 

If the campaign limit amount organized by the SELLER falls below due to the use of the right of withdrawal, the discount amount benefited within the scope of the campaign is canceled.


PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

Products prepared at the BUYER's request or clearly in line with personal needs and not suitable for return, underwear bottom pieces, swimsuit and bikini bottoms, make-up materials, single-use products, goods that are in danger of spoiling quickly or whose expiration date may pass, products that are not suitable for return in terms of health and hygiene if the packaging is opened by the BUYER after delivery to the BUYER, products that are mixed with other products after delivery and cannot be separated by nature, except those provided under subscription contracts, goods related to periodicals such as newspapers and magazines, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if the packaging has been opened by the BUYER, return is not possible according to the Regulation. Additionally, exercising the right of withdrawal for services whose performance has been started with the consumer's consent before the right of withdrawal period expires is also not possible according to the Regulation.

For cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returned, their packaging must be unopened, untried, unspoiled, and unused.


DEFAULT STATUS AND LEGAL CONSEQUENCES

If the BUYER makes payment transactions with a credit card and defaults, the cardholder accepts, declares and undertakes that he/she will pay interest within the framework of the credit card agreement between him/her and the bank and will be responsible to the bank. In this case, the relevant bank may resort to legal means; may request the expenses and attorney's fees to be incurred from the BUYER, and in any case, if the BUYER defaults on his/her debt, the BUYER agrees to pay the damage and loss suffered by the SELLER due to the delayed performance of the debt.
